Tiemio

For employers with part-time staff

Part-time hours, recorded every day and totalled every month.

The law asks more for part-time contracts: each day's hours, the month's total and a copy for the employee with their payslip. Tiemio keeps the days and prepares the month.

In short

A part-time employee's hours must be recorded day by day and totalled each month, and the employee gets a copy of that monthly summary, every hour worked included, with their payslip (article 12.4.c of the Workers' Statute). Without that record, the contract is presumed full-time unless you can prove otherwise.

In Tiemio the employee taps Start work and Finish work on their own phone, so each day is recorded as it happens. At the end of the month the timesheet holds every day and the month's total, and you send it for signature in the app: their signature shows they received it.

A part-time month

  1. 09:00

    His morning starts

Mikel works four hours, Monday to Friday mornings. He taps Start work on his phone as he arrives; you see at once that he is working.

  2. 13:00

He finishes, and the day is recorded

He taps Finish work. The day shows its start, finish and hours worked, recorded at the time, not filled in at the end of the week.

  3. Saturday

    He covers an extra shift

Three hours on a Saturday are recorded like any others. His timetable is weekday mornings, so the time is flagged as outside the timetable, never refused, and either of you can add a note saying why.

  4. Tuesday

    A forgotten Finish work

He left without tapping. He asks for a correction from his phone with the real time and a reason; you approve it. The original tap stays, with the correction beside it.

  5. End of month

The month, totalled and handed over

In Records, Sign and send the month: Mikel gets a notice, reads each day and the total, and signs in the app, or signs as not agreeing and says why. Download the PDF to hand over with his payslip, or for your gestoría.

What a part-time contract needs from the record

  • Each day recorded as it happens

One tap to start, pause, resume and finish, on the employee's own phone. Short days, split mornings and the odd Saturday are all recorded the same way, with no clock on the wall.

  • The month sent, and signed

The monthly timesheet lists every day and the month's total. Send it for signature in the app: the employee signs, or signs as not agreeing with a reason, and every answer is kept with the month. The PDF shows both signatures.

  • A timetable for each person

Give a part-timer the hours they are contracted for, such as weekday mornings, from a date. Time outside them is still recorded, only flagged, so extra hours never go missing from the month.

what the contract is presumed to be without the record

A part-time employee's working day is recorded day by day and totalled each month. The employer gives the employee, with the payslip, a copy of the summary of every hour worked that month, both the ordinary hours and the complementary ones, and keeps the monthly summaries for at least four years. Without that record, the contract is presumed to be full-time unless the employer proves otherwise (article 12.4.c of the Workers' Statute).

Part-time employees cannot work overtime, except to prevent or repair damage in an emergency (articles 12.4.c and 35.3). Hours beyond the contract are complementary hours: only with a written agreement, in contracts of at least ten hours a week, up to 30% of the contracted hours (a collective agreement can raise it to 60%), known at least three days ahead (article 12.5). Breaking the rules on the working day, complementary hours or the record is a serious infringement (article 7.5 LISOS), fined from €751 to €7,500 (article 40.1.b).

Key point

For a part-time contract the record is what proves the part: without it, the law presumes full-time.

Questions

Do part-time employees need a different time record?

The same daily record as everyone, plus two things: the hours are totalled each month, and the employee gets a copy of that monthly summary with their payslip. The monthly summaries are kept for four years.

Is Tiemio's monthly timesheet the summary the employee must get?

It holds what the summary needs: each day's hours and the month's total, every hour worked included. You can send it for signature in the app, where the employee signs or says why they do not agree, and download the PDF to hand over with the payslip. A signature is the simplest way to show it was handed over.

Does Tiemio separate complementary hours from ordinary hours?

No. The timesheet totals every hour worked, without splitting them. If the person has a timetable for their contracted hours, time outside it is flagged on each day, which shows where the extra hours were. The split itself goes on the payslip, as the law asks.

What if the record is missing or incomplete?

The contract is presumed to be full-time unless you prove the hours were part-time, and the Labour Inspectorate can fine a missing or wrong record as a serious infringement, from €751 to €7,500.

My part-time employee also works for someone else. Is that a problem?

No. One person can work for several employers in the same Tiemio app, clocking in for one at a time. Each employer sees only their own hours.
